Privacy Statement

Preamble

In this Privacy Statement, “we”, “us” and “our” “MET Group” shall have the meaning of MET Holding AG and its consolidated subsidiaries.

The member companies of the MET Group are committed to safeguarding the privacy of the personal data of the visitors of their Websites with the URL met.com (hereinafter Websites).

Please read carefully the following Privacy Statement to understand how any personally identifiable information and non-personally identifiable information that you provide by visiting the Websites (hereinafter Information) will be processed.

The member companies of MET Group as data controllers (each accessible at: dataprotection@met.com) gather and process the type of Information for the purposes, on the legal grounds and during the period, and transfers such Information to the recipients specified in this Privacy Statement, the General Customer Data Privacy Notice of MET Group (hereinafter General Data Privacy Notice) and the Data Protection Notice of MET Group (hereinafter Recruitment Data Protection Notice.)  in compliance with the General Data Protection Regulation (hereinafter GDPR) and the relevant national data protection legislation.

How long do we keep your personal data?

We will process your data in accordance with the purpose limitation principle for as long as it is strictly necessary for the purpose for which it is processed. If there is no other specific retention period, we will delete your data once the specific task is completed.

Processing of Information

MET Group does not actively collect personally identifiable information from the Websites except when specifically, and knowingly provided by you (e. g using our career website). While you browse our Websites, some information may be recorded passively. We make use of tracking technology ("Cookies") to gather such data as browser type and operating system, metrics, geographical location and understanding how visitors use the Websites. Contact form

You can contact us by filling in the Contact Form. You will then be asked to provide your name, email address and optionally your telephone number (if you are expecting a response from us by phone). Alternatively, your message may contain other personal information, depending on the content of the message. Personal data will be processed for the purpose of fulfilling the request in your message or answering your question, based on your consent. We will not use the information you provide through the Contact Form for any other purpose. By sending the message and ticking the box, you consent to the processing of your data as described in this notice. Your data will be processed until your request or question is answered. If your message is related to the pursuit of any claim, or if such connection may arise in relation with your message, we will process your personal data until the end of the 5th year after the related proceedings have become final or the claim has elapsed. 

Acknowledgment

By clicking the box, you acknowledge our processing of Information according to the terms of this Privacy Statement and General Data Privacy Notice and the Recruitment Data Protection Notice.

Providing consent is not a condition of any contract. If you do not give your consent, the consequence may be that we will not be able to answer your question or request, but there will be no negative consequences for you.

Data controller and contact details

MET group companies act as joint data controllers for the operation of the Website as it is in the interest of all MET companies to operate MET Group’s and MET entities websites. However, personal data will be collected and processed primarily by MET Holding AG. 

An agreement on joint controllership exists between the members of the MET group. MET Holding AG is designated as the primary controller in relation to the processing of your personal data and as the controller responsible for the lawfulness and security of the processing. Therefore, MET Holding AG is the primary contact point for you to enforce your rights.

Security

MET Group takes appropriate technical and organizational measures to ensure the protection of your Information. In frame of this we use up-to-date data storage and security techniques to protect your Information from unauthorized access, improper use or disclosure, unauthorized modification or unlawful destruction or accidental loss. All our employees and any third parties we engage to process your Information are obliged to provide the confidentiality any Information provided by you.

What rights do you have in relation to data processing?

You may request MET to do the following actions:

- provide detailed information on the processing of your personal data.

- access to personal data. In this context, you have the right to be informed whether personal data are being processed, to obtain access to and a copy of the personal data processed and to obtain information relevant for data protection purposes (e.g. categories of recipients, storage period).

If you would like details of the Information which you have submitted to us through the Websites, you have a right of access to such information and you may email us at: dataprotection@met.com.

- rectification of personal data. In this context, you may request the correction of incorrect data or the completion of incomplete data.

If you would like to update any Information you have submitted through the Websites, please contact us via the above email address.

- erasure of personal data. In this context you may request us to erase your personal data, subject to the relevant legislation.

- restriction of data processing, if, (i) the accuracy of the personal data is contested by the data subject, for a period enabling MET to verify the accuracy of the personal data; (ii) the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead; (iii) MET no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims; (iv) the data subject has objected to processing pending the verification whether the legitimate grounds of MET override those of the data subject.

- object to the data processing, on grounds relating to your particular situation, at any time, to the processing of personal data concerning you which is based on legitimate interest. In such a case, MET shall no longer process the personal data unless MET demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or if data processing is necessary for the establishment, exercise or defence of legal claims.

Consent may be withdrawn at any time: if the legal basis for the processing of data is your consent, you may withdraw your consent at any time, without prejudice to the lawfulness of the processing before the withdrawal.

Requests to exercise the above rights may be sent to MET or any MET group entity using the contact details set out herein, in form of a written request (via e-mail) in which we can identify you. We will comply with the request as soon as possible, but within a maximum of one month, and will inform you of the action taken and, in case your request is refused, the reasons for refusing the request.

Right to lodge a complaint: If you consider that the processing of your personal data through the Websites by MET infringes the provisions of the data protection legal regulations, you have the right to lodge a complaint with the competent data protection supervisory Authority in the State of your habitual residence, place of work or the place of the alleged infringement. You can find a list of the national data protection authorities in the EU here and contact with the Federal Data Protection and Information Commissioner of Switzerland here.

Before submitting a complaint to the authority, we recommend that you first send your request to MET or any of the MET group entities so that the request can be examined by MET group in the first instance and that we can resolve the problem quickly.

Judicial remedy: you can also turn to the relevant court if your rights are infringed.

Information on recipients

Within MET, personal data can be accessed especially by our marketing department, IT department, compliance and security department. In the operation of the Websites, we may use various subcontractors, such as IT service providers, to assist with website development or maintenance. They are considered as data processors of MET. They may have access to personal data submitted using e.g. the Contact Form. We may also use external consultants, such as legal advisors, to assist us in our operations, if necessary, in order to resolve a case. Certain personal data may be disclosed to such advisors, subject to a confidentiality undertaking. Such consultants are typically considered as independent data controllers.

Details of data transfers to third countries outside the EU

The primary data processor MET Holding AG is located in Switzerland. As you provide your data directly to this company, there is no formal transfer of data from the EU to a third country. We note however, that there is an adequacy decision of the European Commission 2000/518/EC in place in relation to data transfers from the EU to Switzerland. Please also note that Swiss data protection law is fully compliant with EU data protection law.

When transferring data to another MET company that is not established in an EU Member State, the transfer will be governed by the Standard Contractual Clauses according to the COMMISSION IMPLEMENTING DECISION EU (2021/914) on standard contractual clauses for the transfer of personal data to third countries pursuant to Regulation (EU) 2016/679, included in the contract applicable to intra-group transfers between the MET group entities. 

Transfers to a recipient in a third country, i.e. outside the EU and the EEA, other than set out herein, is not planned to take place.

Changes to the Privacy Statement

MET Group reserves the right to change this Privacy Statement as needed. Any changes to this Privacy Statement, by being uploaded, will be promptly communicated and be effective once you acknowledged it by clicking the box on the Websites.
